Why not hit up the animal shelter or rescue and look for a medium sized terrier mix? Tiny dogs are not great with little kids as they are very fragile and can be snippy, something in the 15-20 lb range should be fine, no matter how big your yard is, you still have to take the dog for walks. And I'm guessing you and your brother would not be too happy with some fluffy froofroo looking dog.
